You agree to act only on the instructions of Samsung as the case may be in relation to the processing of any personal information provided to you by Samsung and shall upon request by Samsung promptly return all such personal information to Samsung as the case may be, or if so requested by Samsung, destroy such data.
  17. You acknowledge that this Site may include certain inaccuracies or typographical errors which may affect the quality of materials and third-party content. You acknowledge that the materials or any third-party content have not been independently verified or authenticated in whole or in part by Samsung, and agree that Samsung does not warrant the accuracy or timeliness of materials or the third-party content, and further agree that Samsung has no liability for any omissions in the materials and content, whether provided by Samsung or any third-party.

Notwithstanding the foregoing, Samsung has the right to seek injunctive remedies or an equivalent urgent legal relief in any jurisdiction.

You unconditionally consent and agree that any claim, dispute or controversy (whether in contract, tort, or otherwise) you may have against any Samsung entity, its officers, directors, agents and employees of any Samsung entity arising out of, relating to, or connected in any way with the Materials or the determination of the scope or applicability of this clause, will be resolved between the parties within 10(ten) business days from the date on which the dispute was referred to them. Should the parties fail to resolve the dispute within the specified period either of the parties shall refer the matter to arbitration where the dispute shall be finally resolved. The dispute shall be submitted for arbitration in the English language in accordance with the Standard Rules of the Arbitration Foundation of South Africa (“AFSA”), or such other rules as may be agreed by the Parties.
  22. Any arbitration in terms hereof shall be conducted in camera and the parties shall treat as confidential and not disclose to any third party details of the dispute submitted to arbitration, the conduct of the arbitration proceedings or the outcome of the arbitration without prior written consent of the other party.
  23. Nothing herein contained shall be deemed to prevent or prohibit a party from applying to the appropriate Court for an interdict, urgent relief or for judgment in relation to a debt or claim that is undisputed.
  24. The failure of Samsung to enforce any right or provision in these terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Samsung in writing. The terms comprises the entire agreement between you and Samsung and supersede all prior or contemporaneous negotiations, discussions or agreements, if any, between the parties regarding the subject matter contained herein. Your use of the Site, however, is subject to the additional Terms & Conditions, disclaimers and caveats that may appear throughout the Site.
  25. If for any reason any clause of this Legal Policy or part thereof becomes void or unenforceable, it shall be severable from the remainder of this Legal Policy which shall remain of full force and effect
  26. No indulgence granted by Samsung shall constitute a waiver or abandonment of its rights in terms of this agreement or Terms and Conditions. Accordingly, Samsung shall not be precluded, as a consequence of having granted that indulgence, from exercising any rights against you which may have arisen in the past or which may arise in the future.

Samsung may use any and all information submitted by you, as per its discretion, to protect the rights, property or safety of itself, or any of our respective affiliates, business partners, employees or customers, for example, in legal proceedings, internal investigations and investigations by competent authorities. Samsung reserves the right to share your information with any entity, on the grounds of reasonable suspicion of fraud or any other criminal activities for the allowance of any investigations into such allegations of fraud or any other criminal activity.
